Streamlined Amended Returns: When to File Form 1040-X Instead of Form 1040

Under the IRS streamlined procedures, any of the last three years you already filed is corrected on Form 1040-X, while years you never filed go in as original Forms 1040.

Streamlined amended returns are Form 1040-X returns you file under the IRS Streamlined Filing Compliance Procedures for any of the last three years in which you already filed a US return but left out foreign income or a required information form. Years you never filed get an original Form 1040 instead. Both kinds go in one paper package with a signed certification and six years of FBARs.

Most guides to the streamlined procedures assume you filed nothing at all. In practice, many Americans in the UK and UAE did file, using US software that ignored their ISA, their UK pension or their Dubai bank account. This guide explains when the IRS wants a Form 1040-X rather than a Form 1040, how to build each amended return, and the mistakes that make the IRS process a submission outside the programme.

When streamlined amended returns are required

The rule turns on one question for each year: did you file a US return for it? The IRS page for the Streamlined Foreign Offshore Procedures says that where a return was previously filed, you submit a complete and accurate amended return on Form 1040-X. Where no return was filed, you submit a delinquent original Form 1040. Consequently, the form type is decided year by year, not for the submission as a whole.

Streamlined amended returns in a mixed submission

A mixed submission is common. For example, you may have filed for 2022 while still in the US, then stopped after moving to London. Your three-year package would then hold one Form 1040-X for 2022 and two original Forms 1040 for 2023 and 2024. Each return carries the marking and certification copy described below, so the IRS can process them together.

Foreign Offshore versus Domestic Offshore

The two streamlined routes treat prior filings very differently. Therefore, check which one you qualify for before preparing anything, because the non-residency requirement decides the route.

The IRS Streamlined Domestic Offshore page states plainly that you may not file delinquent income tax returns under that route. If you missed a year while living in the US, the domestic route is closed to you. We compare the two penalties in more detail in our guide to the streamlined domestic offshore penalty.

What goes into each Form 1040-X

An amended return under the streamlined procedures must be complete and accurate for the whole year. It is not a short correction of one line. Instead, it restates the full return with every item of worldwide income and every information return that should have been attached the first time.

The income you probably left out

For Americans in the UK, the usual omissions are ISA interest and dividends, gains on UK funds, UK rental profit and income from a UK limited company. For Americans in the UAE, the usual gap is interest on local deposits and income from a free zone company. Furthermore, UK and Irish-domiciled funds held in an ISA are often passive foreign investment companies, which need Form 8621 on the amended return. Our guide to PFIC rules for Americans explains why these funds cause so much trouble.

The information returns that travel with it

The IRS lists Forms 3520, 5471 and 8938 among the information returns to include. Similarly, Form 8621 for PFICs and Form 8865 for foreign partnerships belong with the year they relate to. Mark each information return "Streamlined Foreign Offshore" in red at the top of its first page, exactly as you mark the Form 1040-X itself.

Claiming relief you missed the first time

Your amended return can also add relief you failed to claim. For instance, you can add Form 1116 to claim the foreign tax credit for UK income tax, or Form 2555 for the foreign earned income exclusion. Note that Treasury Regulation section 1.911-7 limits late Form 2555 elections, so a credit-based return is often the safer choice for back years.

How to assemble the package

The streamlined procedures are paper only. The IRS states that electronic submissions will not be accepted, so you cannot e-file the Form 1040-X even though ordinary amended returns can now be filed electronically. Accordingly, every return, schedule and certification goes in one envelope to the Austin, Texas address on the IRS page.

The certification and the narrative

Form 14653 is the certification of non-willful conduct for SFOP. You sign the original once and attach a copy to each tax and information return, but not to the FBARs. Above all, the narrative must give specific reasons for each failure. Our guide to Form 14653 sets out what the IRS expects from that statement.

Payment and interest

You must pay all tax shown on the returns plus statutory interest when you submit. Write your taxpayer identification number on the cheque. In addition, the IRS page warns that previously assessed penalties for those years will not be abated, so a penalty notice you already received stays in place.

The six years of FBARs

Separately, you file FinCEN Form 114 electronically for the most recent six years whose FBAR due date has passed. Corrected FBARs follow the same rule as returns: if you filed one that omitted an account, you file an amended FBAR rather than a new one. Our FBAR and FATCA reporting page covers the account-by-account rules.

Common mistakes with streamlined amended returns

Most rejected or reprocessed submissions fail for avoidable reasons. In our experience reviewing UK and UAE packages, three errors come up again and again.

Amending only the line that changed

A 1040-X that adds ISA interest but ignores the UK fund, the pension and the missing Form 8938 is not complete and accurate. Consequently, the certification on Form 14653 becomes untrue. Build each year from scratch using every bank, broker and pension statement.

Missing the red marking

Without the red heading on page one, the IRS can treat the return as an ordinary amendment. The IRS also says that if you omit the certification, it processes the returns under normal procedures, without the streamlined penalty relief.

Expecting a refund without checking time limits

An amended return that adds foreign tax credits can show an overpayment. However, the IRS streamlined page does not address refund claims, and any refund remains subject to the normal limits in Internal Revenue Code section 6511. Treat a refund as a possible bonus, not the reason to file.

A worked example from London

Consider an illustrative client, Sarah, a US citizen in London since 2021. She filed Forms 1040 for 2022, 2023 and 2024 using US software, claiming the foreign earned income exclusion on her salary. She did not report £1,800 a year of ISA dividends from two UK funds or file Form 8938. She had also never filed an FBAR.

Sarah qualified for SFOP because she met the non-residency requirement. Her package held three Forms 1040-X adding the dividends, Forms 8621 for both funds and Form 8938 for each year. It also included a signed Form 14653 and six electronic FBARs. Her additional US tax was modest, although ISA income carries no UK tax, so there was no foreign tax credit to offset it. More importantly, the programme removed her exposure to FBAR penalties.

Next steps

Getting streamlined amended returns right the first time matters, because the certification is signed under penalty of perjury. If you filed US returns but missed foreign income or forms, book a consultation with Tranzesta. We will map each year, confirm your route and prepare the full package.

Frequently Asked Questions

Do I file Form 1040 or Form 1040-X under the streamlined procedures?

You file Form 1040-X for any of the last three years in which you already filed a US return, and an original Form 1040 for any year you never filed. Under the Streamlined Foreign Offshore Procedures you can mix both in one submission. Under the Streamlined Domestic Offshore Procedures you must have filed every year, so only Forms 1040-X are allowed.

Can streamlined amended returns be e-filed?

No, streamlined amended returns cannot be e-filed. The IRS states that electronic submissions are not accepted under the Streamlined Filing Compliance Procedures. You mail the paper Forms 1040-X, information returns, the signed certification and payment to the Austin, Texas address on the IRS page. Only the FBARs (FinCEN Form 114) are filed electronically.

What do I write on top of a streamlined Form 1040-X?

You write "Streamlined Foreign Offshore" or "Streamlined Domestic Offshore" in red at the top of the first page. The same marking goes on every information return in the package, such as Form 8938 or Form 8621. Without it, the IRS can process the return as an ordinary amendment without streamlined penalty relief.

Can I use the streamlined procedures if I live in the UK and already filed US returns?

Yes, an American living in the UK who already filed US returns can use the Streamlined Foreign Offshore Procedures, provided they meet the non-residency requirement and the failure was non-willful. They file Forms 1040-X for previously filed years, Form 14653, and six years of FBARs. For joint returns, both spouses must meet the non-residency requirement.

Do Americans in the UAE pay a penalty on streamlined amended returns?

Americans in the UAE who qualify for the Streamlined Foreign Offshore Procedures pay no Title 26 miscellaneous offshore penalty. They pay only the tax shown on the amended returns plus statutory interest. Because the UAE levies no personal income tax, any additional US tax usually comes from unreported interest or investment income rather than salary.

Will the IRS cancel penalties I was already charged for those years?

No, the IRS will not cancel penalties already assessed for the years in a streamlined submission. The IRS Streamlined Foreign Offshore page states that previously assessed penalties for those years will not be abated. The programme protects you from future failure-to-file, accuracy and FBAR penalties for the covered years, subject to its conditions.
