UK State Pension US tax treatment depends on where you live. If you are resident in the US, Article 17(3) of the UK-US Income Tax Treaty makes the UK State Pension taxable only in the United States. If you are a US citizen resident in the UK, the UK taxes it as ordinary income, and most advisers treat it as taxable in the US too, with a foreign tax credit for the UK tax. It is not an FBAR account.
The UK State Pension is a government benefit earned through National Insurance contributions. Many Americans who worked in Britain, and many Britons who retired to the US, receive it alongside US Social Security. It is paid without any tax deducted, which makes it easy to overlook on both returns. This guide covers how each country taxes it, how the treaty divides the taxing rights, and what changed when the US repealed the Windfall Elimination Provision. It does not cover workplace or private pensions.
How the UK State Pension works before US tax
The full new State Pension is £241.30 a week for 2026/27, following a 4.8% increase in April 2026 (GOV.UK, 2026/27). You normally need 35 qualifying years of National Insurance for the full amount and at least 10 years to receive anything. State Pension age is 66 and is rising to 67 between 2026 and 2028. GOV.UK sets out the rules on its new State Pension page.
UK tax on the State Pension
The State Pension is taxable income in the UK, but it is paid gross. HMRC collects any tax due by adjusting the tax code on another pension or job, or through Self Assessment. At £241.30 a week, the full new State Pension is about £12,548 a year, just under the £12,570 Personal Allowance for 2026/27. Therefore, someone with no other income pays no UK tax on it, while someone with other income effectively pays tax on all of it.
UK State Pension US tax rules by residence
The treaty contains a specific rule for social security payments. Article 17(3) says that payments under a country's social security legislation, made to a resident of the other country, are taxable only in that other country. Importantly, Article 17(3) is one of the exceptions to the saving clause, so it binds the US even for its own citizens. Our guide to the saving clause exceptions explains why that matters.
| Your situation | UK tax | US tax | Treaty basis |
|---|---|---|---|
| US resident, any citizenship | None | Yes, taxable only in the US | Article 17(3) |
| US citizen resident in the UK | Yes, as ordinary income | Generally yes, with foreign tax credit | Saving clause, Article 24 credit |
| UK citizen resident in the UK, not a US person | Yes | None | Not a US taxpayer |
| US citizen resident in the UAE | Depends on UK domestic law and the UK-UAE treaty | Yes | No US-UAE income tax treaty |
If you live in the United States
A US resident reports the UK State Pension on Form 1040 as pension income. It is generally treated as fully taxable, because the favourable rule that taxes at most 85% of US Social Security benefits applies only to US benefits. Convert each payment at the exchange rate on the date received, or use the IRS yearly average rate consistently. The UK does not tax it, so no foreign tax credit arises.
If you are a US citizen living in the UK
Article 17(3) deals with a payment made by one country to a resident of the other. A UK State Pension paid to a UK resident is not that situation. As a result, most advisers conclude that the saving clause leaves the US free to tax its citizen, and they report the pension on Form 1040 and claim a foreign tax credit on Form 1116 for the UK tax. Where little UK tax is paid, because the pension sits within the Personal Allowance, some US tax can remain. The reverse position, US Social Security paid to a UK resident, is covered in our guide to US Social Security for UK residents.
The Windfall Elimination Provision has gone
Until recently, receiving a UK State Pension could reduce your US Social Security benefit under the Windfall Elimination Provision (WEP). The Social Security Fairness Act, signed in January 2025, repealed the WEP and the Government Pension Offset for benefits payable after December 2023. Consequently, a UK State Pension no longer reduces US Social Security retirement benefits. The Social Security Administration explains the change on its Social Security Fairness Act page. Anyone whose benefit was reduced in the past should check that it has been recalculated.
Combining contribution records
The US-UK Totalization Agreement lets you combine periods of coverage in both countries to qualify for a benefit you would otherwise miss. For example, someone with eight UK qualifying years can use US coverage to meet the UK's 10-year minimum. Each country then pays a benefit based only on its own contributions. Our guide to the US-UK Totalization Agreement explains how.
UK State Pension US tax reporting: FBAR and Form 8938
An entitlement to the UK State Pension is not a financial account, so it is not reported on the FBAR. The IRS also states that payments or rights under a foreign government's social security programme are not specified foreign financial assets for Form 8938. However, the UK bank account the pension is paid into is reportable in the normal way.
An illustrative case
Consider an illustrative couple. He is British, she is a US citizen, and both worked in the UK for 30 years before retiring to Florida in 2026. The facts are illustrative. Each receives a UK State Pension. As US residents, both are taxed on it only in the US under Article 17(3), and both report it in full on their joint Form 1040. Had they stayed in Surrey, the UK would have taxed both pensions, and she alone would also have reported hers to the IRS, claiming a credit for UK tax. The move changes which country taxes the same payment, which is the heart of the UK State Pension US tax rules. Our UK-US tax treaty page covers the other pension articles.

Frequently Asked Questions
Is the UK State Pension taxable in the US?
Yes, for US residents and generally for US citizens abroad. Under Article 17(3) of the UK-US Income Tax Treaty, a UK State Pension paid to a US resident is taxable only in the United States. It is reported on Form 1040 as pension income.
Does the UK tax my State Pension if I live in the US?
No. Article 17(3) of the UK-US Income Tax Treaty gives the country of residence the sole right to tax social security payments. A UK State Pension paid to a US resident is therefore not taxed by the UK.
Is the UK State Pension taxed like US Social Security?
Generally no. The rule limiting tax to at most 85% of benefits applies to US Social Security. A UK State Pension received by a US taxpayer is generally treated as fully taxable pension income.
Does a UK State Pension reduce my US Social Security?
No longer. The Social Security Fairness Act, signed in January 2025, repealed the Windfall Elimination Provision for benefits payable after December 2023. A UK State Pension no longer reduces US Social Security retirement benefits.
Do I report my UK State Pension on the FBAR?
No. A right to the UK State Pension is not a foreign financial account, so it is not reported on the FBAR, and the IRS does not treat foreign social security entitlements as specified foreign financial assets for Form 8938. The bank account that receives the payments is reportable.
How much is the full UK State Pension in 2026/27?
The full new State Pension is £241.30 a week for 2026/27, about £12,548 a year, after a 4.8% increase in April 2026 (GOV.UK). You normally need 35 qualifying National Insurance years for the full amount and at least 10 to receive any.
