For a US citizen at a UK university, USS contributions are generally excluded from US income under Article 18(5), but the Investment Builder pot still belongs on the FBAR.

The USS pension US tax position splits at the scheme's salary threshold. For a US citizen working at a UK university, contributions to the Universities Superannuation Scheme are generally excludable from US income under Article 18(5) of the US-UK treaty, and growth is deferred under Article 18(1). Benefits are taxed in the US when paid. The Investment Builder pot also needs FBAR and Form 8938 reporting.

American academics often assume their USS membership is invisible to the IRS because UK payroll handles everything. It is not. USS is two pensions in one, a defined benefit half and a defined contribution half, and each behaves differently on a US return. This guide shows how to treat both, with a worked example for a professor earning above the threshold.

How USS is built: two pensions in one

The Universities Superannuation Scheme is a hybrid scheme for UK higher education staff. Salary up to the threshold builds a defined benefit pension in the Retirement Income Builder (RIB). Salary above the threshold goes into the Investment Builder (IB), a defined contribution pot invested in funds.

The 2026/27 figures

Why the split matters for US reporting

A defined benefit promise has no account you can withdraw from. By contrast, the Investment Builder holds a balance in your name, invested in pooled funds. That difference drives the FBAR, Form 8938 and PFIC answers later in this guide.

USS pension US tax on contributions

Article 18(5) of the US-UK tax treaty protects US citizens who live and work in the UK. Contributions to a UK pension scheme while employed in the UK are deductible or excludable in the US. Similarly, employer contributions and benefits accrued are not treated as taxable income. Importantly, Article 1(5)(a) carves Article 18(5) out of the saving clause, so US citizens can use it.

The cap on Article 18(5) relief

The relief cannot exceed the lesser of two amounts. The first is the relief the US would give for a generally corresponding US plan. The second is the relief the UK actually gives. For 2026, IRS Notice 2025-67 sets the 401(k) elective deferral limit at $24,500, the total defined contribution limit at $72,000 and the defined benefit limit at $290,000, according to the IRS COLA table.

Salary exchange and your US wage figure

Many universities run USS through salary exchange, so your P60 pay is already net of member contributions. In that case, the UK figure and the treaty-adjusted US wage figure usually match. If your university uses the net pay arrangement instead, check that your US wages are reduced for contributions only once. Our guide to UK pension contributions and Article 18 explains the disclosure most advisers make on Form 8833.

Worked example: a professor above the threshold

The figures are illustrative. Dr Ellis, a US citizen, earns £90,000 at a UK university in 2026/27 and has no other pension.

What builds up in USS

In the Retirement Income Builder, Dr Ellis accrues a pension of £74,208 ÷ 75 = £989.44 a year, plus a lump sum of 3/75 = £2,968.32. In the Investment Builder, the excess salary of £15,792 attracts 20%, which is £3,158.40. Of that, Dr Ellis pays £963.31 and the university pays £2,195.09. Total member contributions across both parts are 6.1% of £90,000, which is £5,490.

Testing the Article 18(5) cap

At an illustrative rate of $1.30 to the pound, the Investment Builder contributions are about $4,106. That is far below the $72,000 defined contribution limit for 2026. Likewise, a £989 annual pension accrual is a tiny fraction of the $290,000 defined benefit limit. Therefore, the full contributions and accruals fall within the treaty relief, and Dr Ellis reports no extra US income from USS for 2026.

What the example teaches

For almost every USS member, the US limits are not the constraint. The real risk is administrative: double-counting the exclusion, or forgetting to disclose the treaty position.

Reporting your USS pension while you work

The treaty defers the tax, but it does not remove the information returns. Each half of USS needs its own answer.

US formRetirement Income BuilderInvestment Builder
FBAR (FinCEN Form 114)Generally not an accountCommonly reported as a foreign financial account
Form 8938Reportable; value may be nil if unknown and nothing paidReportable at maximum value
Form 8621 (PFIC)Not applicableGenerally excepted for treaty pension funds

FBAR and Form 8938

The Investment Builder has a balance, so most practitioners include it on the FBAR when foreign accounts exceed $10,000 in aggregate, as explained by FinCEN. Both halves are specified foreign financial assets for Form 8938. The Form 8938 instructions let you report a foreign pension at the value of distributions received when you do not know its fair market value. That is helpful for the RIB. Our FBAR and FATCA reporting pillar covers thresholds in full.

PFIC and Form 3520

The Investment Builder invests in pooled funds that could be PFICs. However, Treasury Regulation section 1.1298-1(c)(4) excepts PFIC shares held through a treaty-recognised pension fund from Form 8621. Our guide to UK pensions and Form 8621 covers the conditions. Form 3520 relief for tax-favoured foreign retirement trusts is discussed in our UK pension Form 3520 guide.

Leaving UK academia or retiring

Moving back to the US with deferred benefits

If you move to a US institution, your USS benefits stay deferred. Article 18(1) continues to defer US tax on growth inside the scheme while you are a member resident in the US. Keep annual statements, because you still need the Investment Builder value for Form 8938.

Drawing your pension

Once paid, the USS pension is taxable in your state of residence under Article 17(1)(a). If you live in the US, file HMRC Form US-Individual 2002 to stop UK PAYE. Note that USS is not a government service pension, because universities are not the State. The different rules for Civil Service and Armed Forces pensions are explained in our guide to UK government pension US tax. For the RIB lump sum and Investment Builder tax-free cash, see our guide to the UK pension lump sum and US tax.

USS checklist for American academics

  • Download your annual USS benefit statement showing both RIB and IB values.
  • Check whether your university uses salary exchange or the net pay arrangement.
  • Exclude contributions from US wages once only, and disclose the Article 18(5) position.
  • Include the Investment Builder on the FBAR and both halves on Form 8938.
  • Keep records of any AVCs or match contributions, which also sit in the Investment Builder.
  • Before retirement, model the US treatment of the lump sum alongside the UK tax-free amount.

Frequently Asked Questions

Do US citizens pay US tax on USS pension contributions?

US citizens working for a UK university generally do not pay US tax on USS contributions. Article 18(5) of the US-UK treaty lets them exclude member and employer contributions from US income, up to the relief available for a comparable US plan. The position should be disclosed on the US return, usually on Form 8833.

Is the USS Investment Builder reportable on the FBAR?

The USS Investment Builder is commonly reported on the FBAR because it holds an invested balance in the member's name. The FBAR applies when the combined value of foreign financial accounts exceeds $10,000 at any time in the year. The defined benefit Retirement Income Builder has no account balance and is generally not treated as an FBAR account.

Do I need to file Form 8938 for my USS pension?

Yes, a USS pension is a specified foreign financial asset for Form 8938 if you exceed the filing threshold. For taxpayers living abroad, the threshold starts at $200,000 at year end or $300,000 at any time for single filers. The defined benefit part may be reported at nil if its value is unknown and nothing was paid out.

Are USS Investment Builder funds PFICs?

The funds in the USS Investment Builder could be PFICs if held directly, but Treasury Regulation section 1.1298-1(c)(4) excepts PFICs held through a pension fund that a tax treaty treats as such. Under the US-UK treaty, USS income is taxed only on distribution, so Form 8621 is generally not required for those funds.

Is a USS pension taxed in the UK or the US after I retire to America?

A USS pension paid to a US resident is taxable only in the US under Article 17(1)(a) of the US-UK treaty. To stop UK tax being deducted, you file HMRC Form US-Individual 2002 through the IRS to obtain an NT tax code. USS is not a government service pension, so the Article 19 nationality test does not apply.

What is the USS salary threshold for 2026/27?

The USS salary threshold for 2026/27 is £74,208, as published by participating universities. Salary up to that figure builds defined benefit pension in the Retirement Income Builder at 1/75 a year plus a 3/75 lump sum. Salary above it goes into the Investment Builder defined contribution pot.
